Expert Witness Florida Department of Transportation

Project Details

WGI assisted FDOT District 5 with expert witness guidance and testimony for the FDOT vs. Anthony G. Perrone et al. case related to the I-75 Design-Build project from the Hernando county line to CR 470. A portion of the Perrone property, located immediately adjacent to the I-75 corridor, was acquired through the eminent domain process for storm water management of roadway runoff. The respondent claimed the Department’s drainage design created a “flooding problem” outside FDOT limited access right-of-way and onto private property (owned by Mr. Perrone).

The expert witness testimony by WGI demonstrated the design was sound and consisted of acceptable industry engineering practices, including permit approval from the local jurisdictional agency. The judge found in favor of the Florida Department of Transportation. WGI coordinated with District staff and other FDOT engineers throughout the legal case and through the trial.
